TERMS AND CONDITIONS

1. Agreement to Terms

By engaging Bab Al Fajer Furniture Movers (“Company,” “we,” “us”) for moving services in Abu Dhabi, UAE, you (“Customer,” “you”) agree to these Terms and Conditions. Please read carefully before booking our services.

2. Services Offered

2.1 Scope of Services

We provide professional moving services in Abu Dhabi including:

  • Furniture transportation (residential and commercial)
  • Professional packing and unpacking services
  • Villa, apartment, and office relocations
  • Heavy furniture and specialty item moving
  • Junk removal and disposal services
  • Short-term storage solutions

2.2 Service Limitations

We do NOT transport:

  • Hazardous materials (explosives, flammable liquids, toxic substances)
  • Illegal items or contraband
  • Live animals or plants (without prior arrangement)
  • Perishable food items
  • Items prohibited by UAE law or Abu Dhabi Municipality regulations

3. Booking and Quotes

3.1 Free Assessments

We provide free home/office assessments to generate accurate quotes. Quotes are valid for 30 days from issue date.

3.2 Quote Accuracy

Quotes are based on information provided by the Customer. Additional charges may apply if:

  • Actual inventory exceeds declared items
  • Access conditions differ from assessment (narrow doorways, elevator unavailability)
  • Building protocols require additional time or resources
  • Customer requests additional services on moving day

3.3 Booking Confirmation

Services are confirmed upon:

  • Written acceptance of quote (email or signed agreement)
  • Payment of deposit (if applicable)
  • Confirmation of moving date and time

4. Pricing and Payment

4.1 Payment Methods

We accept:

  • Cash (AED)
  • Credit/debit cards (Visa, Mastercard)
  • Bank transfers
  • Company cheques (for corporate clients)

4.2 Payment Terms

  • Residential moves: 50% deposit, 50% upon completion
  • Commercial moves: Payment terms as per corporate agreement
  • Same-day/emergency services: Full payment upon completion

4.3 Additional Charges

Extra fees may apply for:

  • Weekend or holiday moves (subject to availability)
  • Long-carry distances (if parking unavailable near property)
  • Storage services beyond agreed period
  • Waiting time due to building delays or customer unpreparedness
  • Cleaning services or disposal of additional items

4.4 Cancellation Policy

  • 7+ days notice: Full refund of deposit
  • 3-7 days notice: 50% deposit retained
  • Less than 3 days notice: Full deposit retained
  • Rescheduling: Free if done 5+ days in advance; AED 500 fee for shorter notice

5. Customer Responsibilities

5.1 Pre-Move Obligations

Customers must:

  • Provide accurate inventory and property information
  • Arrange building access, elevator bookings, and parking permits
  • Obtain necessary compound entry approvals
  • Disconnect appliances requiring professional service (washing machines, AC units)
  • Empty drawers and cabinets (unless professional packing service booked)
  • Remove valuable items, important documents, and jewelry from furniture
  • Be present or designate authorized representative on moving day

5.2 Packing Responsibilities

If customer chooses self-packing:

  • Pack items securely using appropriate materials
  • Properly label all boxes
  • Declare fragile or valuable items
  • Acknowledge that Company liability is limited for self-packed items

5.3 Disclosure Requirements

Customers must disclose:

  • High-value items requiring special handling (antiques, artwork)
  • Building restrictions or access challenges
  • Tight deadlines or time-sensitive requirements
  • Any items requiring special permits or handling

6. Company Responsibilities

6.1 Professional Standards

We commit to:

  • Licensed operations per Abu Dhabi Municipality requirements
  • Background-verified, uniformed professional crews
  • Proper equipment and protective materials
  • Respectful treatment of your property and belongings
  • Bilingual service (English and Arabic)
  • Insurance coverage as outlined in Section 7

6.2 Timing

We strive for punctuality but cannot guarantee exact timing due to:

  • Abu Dhabi traffic conditions
  • Building elevator availability
  • Unforeseen circumstances beyond our control

Customers will be notified of significant delays as soon as possible.

7. Liability and Insurance

7.1 Standard Coverage

Our basic liability coverage provides protection for:

  • Damage caused by Company negligence during loading, transport, or unloading
  • Loss of items under Company’s direct control

7.2 Coverage Limitations

We are NOT liable for:

  • Items improperly packed by Customer
  • Pre-existing damage not documented before move
  • High-value items not declared (coverage limited to AED 500 per item unless declared)
  • Fragile items in customer-packed boxes
  • Scratches on furniture from normal wear during moving process
  • Building damage caused by elevator malfunctions or building defects
  • Delays caused by traffic, weather, or building restrictions
  • Items prohibited under Section 2.2

7.3 Additional Insurance

Customers may purchase:

  • Enhanced coverage: For high-value items (artwork, antiques, jewelry)
  • Full replacement value: Premium insurance option
  • Must be requested at time of booking

7.4 Damage Claims

To file a claim:

  • Report damage within 24 hours of move completion
  • Provide photographic evidence
  • Submit written claim form
  • Allow Company to inspect damaged items
  • Claims must be submitted within 7 days for consideration

8. Force Majeure

We are not liable for delays or non-performance due to:

  • Natural disasters or severe weather
  • Government restrictions or emergency orders
  • Building emergencies or access denials
  • Labor disputes or strikes
  • Other circumstances beyond reasonable control

In such cases, we will reschedule at no additional charge or provide full refund.

9. Building and Compound Protocols

9.1 Customer Coordination

Customer is responsible for:

  • Service elevator reservations (especially high-rise buildings)
  • Security clearances at compounds (Al Reef, Raha Gardens, etc.)
  • Parking permits for moving trucks
  • Notification to building management

9.2 Company Compliance

We will:

  • Follow all building move-in/move-out procedures
  • Protect common areas with floor coverings
  • Coordinate with security and management staff
  • Respect building time restrictions

9.3 Building Fines

Customer is responsible for any fines imposed by buildings due to:

  • Incorrect or incomplete booking information provided
  • Building damage caused by oversized furniture (not disclosed)
  • Violations of building rules Customer failed to communicate

10. Storage Services

10.1 Storage Terms

  • Minimum storage period: 7 days
  • Monthly rates apply after initial period
  • Climate-controlled facilities available
  • 24-hour notice required for item retrieval

10.2 Storage Liability

  • Items stored at customer’s risk
  • Insurance available for additional fee
  • Company not liable for deterioration of items requiring specific environmental conditions

11.2 Mediation

If direct resolution fails, parties agree to good-faith mediation before pursuing legal action.

11.3 Jurisdiction

These Terms are governed by UAE Federal Law and Abu Dhabi local regulations. Any disputes will be resolved in Abu Dhabi courts.

12. Intellectual Property

All website content, logos, and marketing materials are property of Bab Al Fajer Furniture Movers. Unauthorized use is prohibited.

13. Limitation of Liability

13.1 Maximum Liability

Our total liability shall not exceed:

  • Declared value: For items with declared high value
  • Invoice amount: For undeclared items
  • AED 500 per item: For items without declared value

13.2 Consequential Damages

We are not liable for:

  • Indirect, incidental, or consequential damages
  • Lost business profits or opportunities
  • Emotional distress
  • Temporary accommodation costs

14. Indemnification

Customer agrees to indemnify Company against:

  • Claims arising from Customer’s negligence or misrepresentation
  • Violations of building rules due to Customer’s failure to disclose
  • Damage to third parties caused by Customer’s undisclosed items
  • Legal fees arising from Customer’s breach of these Terms

15. Privacy and Data Protection

Customer data is handled per our Privacy Policy (above). By engaging our services, you consent to data processing as described.

16. Amendments

We reserve the right to modify these Terms with 30 days notice. Continued use of services constitutes acceptance of updated Terms.

17. Severability

If any provision is found invalid, remaining provisions remain in full effect.

18. Entire Agreement

These Terms, together with your service quote/agreement, constitute the entire agreement between parties.
